This week, the platform went live across the state, letting sports bettors trade on sporting events without breaking any state law. The launch joins Kalshi and Polymarket, two prediction market apps already running the same play in California.

Prediction markets sell shares in event outcomes instead of taking bets against a house. A trader buys a “yes” or “no” share on something like a Dodgers win, and the price moves as more people trade.

The Commodity Futures Trading Commission, a federal agency, regulates these as financial contracts, and prices move in real time as traders buy and sell shares. That federal status lets platforms sidestep state gambling laws, including California’s ban. Users only need to be 18 to trade, compared with the usual 21 minimum for sports betting.

Why Sports Betting Is Still Banned In California

California voters shot down two sports betting measures in 2022. Proposition 27 would have legalized online sports betting statewide, and voters rejected it by more than 82%. Proposition 26, aimed at retail betting on tribal land, also failed.

Tribal casinos, cardrooms, and out of state gambling companies never agreed on how a legal sports betting market should work. That fight stalled any new attempt at legalization, leaving California without regulated online sportsbooks four years later.

How DraftKings Predictions Works For Californians

New users can claim $200 in bonus trades after a $5 deposit. DraftKings built Predictions into its main app, so existing DraftKings customers can log in with the same account, though sportsbook funds stay separate from the Predictions wallet.

Beyond sports, the platform offers contracts on politics, the stock market, weather, and pop culture events. One market lets traders bet on who Time names Person of the Year. Another tracks presidential election odds months in advance.

DraftKings is also marketing hard in Texas, Georgia, and Florida, three more states where traditional sports betting isn’t fully legal. Company leadership has called these markets a way to reach fans in states DraftKings could never enter through a licensed sportsbook.

Not everyone agrees this setup is legal. A California resident filed a lawsuit in Massachusetts, arguing DraftKings Predictions offers sports bets dressed up as financial trades. The suit claims the “trading” label misleads users about what they’re actually doing.

DraftKings maintains its Predictions product operates under federal rules that differ from state sportsbook licensing. That legal question is still working through the courts.

Prediction markets give residents a legal outlet right now, but the rules could shift fast if courts or regulators step in. Congress and state attorneys general are already watching these platforms closely, and a court ruling against DraftKings could pull Predictions from California overnight.
